Terms of Service

3.1 Eligibility

You must be at least 13 years of age to use Linya. If you are between 13 and 18 years old, you must have parental or guardian consent. Some features may require users to be 18 years or older.

3.2 Account Creation

You are responsible for:

• Providing accurate and complete registration information
• Maintaining the security of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized access

3.3 Account Security

You agree to maintain the confidentiality of your login credentials and to notify us immediately of any suspected security breach. Linya is not liable for any loss or damage arising from your failure to protect your account information.

3.4 One Account Per User

Each user is permitted one account. Multiple accounts by the same person are prohibited and may result in account suspension or termination.

5.1 License to Linya

By using our service, you grant Linya a limited, non-exclusive, worldwide license to:

• Store and process your content to provide the service
• Create backups for service reliability
• Display your content back to you within the platform
• Use anonymized, aggregated data to improve our AI models and services

We do NOT claim ownership of your content and will NOT use your specific creative works for training AI models or share them with third parties without your explicit consent.

5.2 AI-Generated Content

Content generated by our AI tools based on your prompts and inputs is considered your content. However, you acknowledge that:

• AI-generated content may not be eligible for copyright protection in all jurisdictions
• Similar prompts may generate similar outputs for different users
• You are responsible for reviewing and ensuring AI-generated content meets your needs and legal requirements

5.3 User Responsibility

You are solely responsible for ensuring you have the rights to any content you upload or incorporate into your work, and that your content does not infringe on third-party rights.

6.1 Subscription Tiers

Linya offers three subscription tiers:

• Free Tier: Basic features with limited AI usage
• Pro Tier: Advanced features including knowledge base, series management, and increased AI limits
• Author Tier: Full access to all features including audiobooks, publishing, marketing, and priority support

6.2 Trial Period

New users may receive a 3-day trial of the Pro tier. The trial will automatically convert to a paid subscription unless cancelled before the trial period ends. No charges apply during the trial period.

6.3 Billing & Renewal

• Subscriptions are billed on a monthly or annual basis as selected
• Subscriptions automatically renew unless cancelled before the renewal date
• Pricing is subject to change with 30 days notice to existing subscribers
• Payment is processed through secure third-party payment processors
• You authorize us to charge your payment method for recurring subscription fees

6.4 Word Packages

In addition to subscription limits, users may purchase additional AI-generated words through one-time word packages. Word packages do not expire and can be used at any time.

6.5 Refund Policy

Refunds are evaluated on a case-by-case basis within 14 days of payment. To request a refund:

• Contact support with your account details and reason for refund
• Refunds may be denied if service abuse is suspected
• Word packages are non-refundable once words have been used
• Trial subscriptions that convert to paid plans may be refunded within 7 days

6.6 Cancellation

You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period. You will retain access to paid features until the end of your billing period. No partial refunds for unused time.

7.1 No Guarantee of Quality

While we strive to provide high-quality AI assistance, we make no guarantees about the quality, accuracy, or suitability of AI-generated content for any particular purpose. The AI may produce content that requires significant editing or may not meet your expectations.

7.2 User Responsibility

You acknowledge that:

• You are responsible for all content you create, edit, or publish using our AI tools
• You must review and verify all AI-generated content before use
• You will not hold Linya liable for any consequences arising from your use of AI-generated content
• The final decision on content use and publication rests with you

7.3 Usage Limits

AI usage is subject to fair use limits based on your subscription tier. We reserve the right to throttle or temporarily restrict access if usage significantly exceeds reasonable limits or appears abusive.

8.1 Linya Platform

The Linya platform, including all software, design, text, graphics, logos, and other materials (excluding user content), is owned by Linya and protected by intellectual property laws. You may not:

• Copy, modify, or reverse engineer any part of our platform
• Use our trademarks or branding without permission
• Create derivative works based on our platform
• Remove or alter any copyright, trademark, or proprietary notices

8.2 Trademarks

"Linya" and associated logos are trademarks of Linya. You may not use these marks without our prior written consent.

8.3 Copyright Infringement

We respect intellectual property rights and expect users to do the same. If you believe your copyright has been infringed, please contact us with:

• Identification of the copyrighted work
• Location of the infringing material on our platform
• Your contact information
• A statement of good faith belief that use is unauthorized
• A statement under penalty of perjury that information is accurate

9.1 No Warranty

We do not warrant that:

• The service will be uninterrupted, secure, or error-free
• The results from the service will meet your requirements
• Any errors will be corrected
• The service or servers are free from viruses or harmful components

9.2 Limitation of Damages

To the maximum extent permitted by law, Linya shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

• Loss of profits, revenue, or data
• Loss of business opportunity
• Service interruption
• Loss or corruption of content

In no event shall our total liability exceed the amount you paid to Linya in the 12 months preceding the claim.

9.3 User Responsibility

You agree to maintain your own backups of your content. We are not responsible for any loss or corruption of your data, regardless of cause.

10.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Linya operates, without regard to conflict of law principles.

10.2 Informal Resolution

Before filing a claim, you agree to contact us and attempt to resolve any dispute informally. Most disputes can be resolved through good-faith negotiation.

10.3 Arbitration

Any dispute that cannot be resolved informally shall be resolved through binding arbitration rather than in court, except that you may assert claims in small claims court if they qualify. Each party will bear their own costs of arbitration.

10.4 Class Action Waiver

You agree to resolve disputes on an individual basis only. You waive any right to participate in a class action lawsuit or class-wide arbitration.

11.1 Termination by You

You may terminate your account at any time by:

• Cancelling your subscription through account settings
• Contacting support to request account deletion

Upon termination, you will retain access until the end of your current billing period.

11.2 Termination by Linya

We may suspend or terminate your account immediately if you:

• Violate these Terms of Service
• Engage in fraudulent or illegal activity
• Abuse the service or other users
• Fail to pay subscription fees

No refunds will be provided for accounts terminated due to violations.

11.3 Data After Termination

After account termination:

• You will have 30 days to export your content
• After 30 days, your content may be permanently deleted
• We are not obligated to retain or provide content after the 30-day period
• Some data may be retained for legal or accounting purposes

11.4 Survival

Sections concerning ownership, liability, dispute resolution, and other provisions that by their nature should survive termination will remain in effect after termination.

12.1 Right to Modify

We reserve the right to modify these Terms at any time. Changes may be necessary due to:

• Legal or regulatory requirements
• New features or services
• Security or operational improvements
• Clarification of existing terms

12.2 Notification

We will notify users of material changes through:

• Email notification to your registered email address
• In-platform notification upon login
• Update to the "Last Updated" date at the top of this page

Notice will be provided at least 30 days before material changes take effect.

12.3 Acceptance of Changes

Your continued use of Linya after changes become effective constitutes acceptance of the modified Terms. If you do not agree to the changes, you must discontinue use and cancel your subscription.
